Terms of Use for Weird Band Website

Welcome to the Weird Band website (the "Site"). By accessing or using the Site, you agree to be bound by these Terms of Use.

General

1.1. The Site is owned and operated by Weird Band, a company registered in Brazil.

1.2. The Site provides information about the Weird Band project, as well as the opportunity to purchase non-fungible tokens ("NFTs") that represent characters from the Weird Band universe.

1.3. By purchasing NFTs on the Site, you acknowledge that you are acquiring a unique digital asset that represents a character from the Weird Band universe, which can be used in games and other musical entertainment experiences. You understand that the NFTs do not represent any financial interest, equity, ownership or security in Weird Band or its affiliates, and that there is no guarantee of any financial return associated with the acquisition of NFTs.

1.4. Weird Band reserves the right to modify or discontinue the Site or the NFTs offered on the Site at any time without notice.

Intellectual Property

2.1. All content on the Site, including but not limited to text, graphics, logos, musics, images, software and code, is the property of Weird Band or its licensors, and is protected by Brazilian and international copyright and trademark laws.

2.2. You may not reproduce, distribute, modify, transmit, adapt, create derivative works of, publicly display or perform, or in any way exploit any of the content on the Site without the prior written consent of Weird Band.

2.3. You acknowledge and agree that Weird Band may use the NFTs purchased by you for promotional or other purposes related to the Weird Band project, without any obligation to compensate you or obtain your further consent.

Disclaimer of Warranties

3.1. The Site is provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and title.

3.2. Weird Band does not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components.

Limitation of Liability

4.1. In no event shall Weird Band or its affiliates, directors, officers, employees, agents or licensors be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of or in connection with the use of or inability to use the Site or the purchase of NFTs, even if Weird Band has been advised of the possibility of such damages.

4.2. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

Indemnification

5.1. You agree to indemnify and hold harmless Weird Band and its affiliates, directors, officers, employees, agents, and licensors from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the Site, your purchase of NFTs, or your breach of these Terms of Use.

Governing Law and Jurisdiction

6.1. These Terms of Use shall be governed by and construed in accordance with the laws of Brazil.

6.2. Any dispute arising out of or in connection with these Terms of Use shall be subject to the exclusive jurisdiction of the courts of Brazil.

By using the Site, you acknowledge that you have read, understood and agreed to these Terms of Use. If you do not agree to these Terms of Use, you should not use the Site.
